Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website at pledgy.com and related services (collectively, the “Service”) operated by Pledgy (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
Pledgy is an online fundraising platform that enables schools and school-affiliated organizations (“Organizations”) to create fundraising campaigns and collect donations from supporters (“Donors”). We provide the technology platform; we are not a party to the donation transaction between Donors and Organizations.
2. Eligibility
You must be at least 18 years old to create an account or make a donation. By using the Service, you represent that you meet this requirement. Organizations must be legitimate school-affiliated entities and provide accurate information during registration.
3. Account Registration
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate, current, and complete information during registration and keep it updated.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at support@pledgy.com if you suspect unauthorized use of your account.
4. Donations and Payment Processing
Processing
All donations are processed by our third-party payment processor, Stripe, Inc. By making a donation, you agree to Stripe's Terms of Service. Your payment information is transmitted directly to and stored by Stripe — Pledgy does not store your full payment card details.
Donation Nature
Donations made through the Service are voluntary contributions to the designated Organization. Pledgy does not guarantee that any Organization is tax-exempt or that your donation is tax-deductible. Donors are responsible for verifying the tax status of the recipient Organization.
Platform Fee
Pledgy is free for Organizations. Donors may be given the option to cover payment processing fees at the time of donation. Any applicable fees are clearly disclosed before payment is submitted.
Donation Receipts
Pledgy provides Donors with a transaction confirmation for each donation. This confirmation is not a tax receipt. Organizations are solely responsible for determining their tax-exempt status and issuing any official donation receipts or acknowledgment letters required by law. Pledgy makes no representations regarding the tax-deductibility of any donation.
Disbursement to Organizations
Funds collected through the Service are held by Stripe and disbursed to Organizations according to Stripe's standard payout schedule. Organizations must complete Stripe's identity verification and onboarding process before receiving payouts. Pledgy reserves the right to delay or withhold disbursement if we reasonably believe a campaign or Organization violates these Terms or applicable law, or if required by Stripe's policies.
Donation Policy
All donations made through the Service are voluntary and generally non-refundable. Donations are intended as contributions to the designated Organization and are not purchases of goods or services.
Fraud and Unauthorized Transactions
If a donation is determined to be fraudulent, unauthorized, or the result of a compromised payment method, Pledgy will work with Stripe and the affected parties to recover and return funds where possible. In such cases:
- If the fraudulent funds have not yet been disbursed to the Organization, they will be reversed automatically.
- If the funds have already been disbursed, Pledgy will make reasonable efforts to recover them from the Organization.
- Chargebacks initiated through your card issuer will be handled in accordance with Stripe's dispute resolution process and applicable card network rules.

5. Organization Responsibilities
Organizations using the Service agree to:
- Use the platform and received funds solely for legitimate school-related purposes.
- Provide accurate and truthful campaign descriptions and fundraising goals.
- Comply with all applicable laws, including those related to charitable solicitation and tax-exempt status.
- Not use the Service for any fraudulent, misleading, or unlawful purpose.
- Complete any identity verification or compliance requirements we reasonably request.
6. Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose or in violation of any applicable law.
- Create campaigns or accounts using false or misleading information.
- Attempt to interfere with, compromise, or disrupt the Service or its underlying infrastructure.
- Scrape, crawl, or use automated means to access the Service without our written consent.
- Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
- Use the Service to launder money or engage in fraudulent financial activity.
- Harass, abuse, or threaten other users of the Service.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by Pledgy and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
Organizations retain ownership of content they upload (logos, campaign descriptions, images). By uploading content, you grant Pledgy a non-exclusive, worldwide, royalty-free license to display that content on the Service for the purpose of operating the platform.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
9. Limitation of Liability
To the maximum extent permitted by law, Pledgy and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, or goodwill, arising out of or related to your use of the Service, whether based on warranty, contract, tort, or any other legal theory.
Our total liability for any claims arising under these Terms shall not exceed the amount you have paid to Pledgy (if any) in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Pledgy and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.
12. Dispute Resolution
These Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Johnson County, Kansas. You consent to the personal jurisdiction of such courts.
13. Changes to These Terms
We may modify these Terms at any time. When we make material changes, we will update the “Effective” date and, where appropriate, notify you by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
